Subpoena service in Texas — witnesses, records, depositions

A subpoena only works if the witness actually gets it — with the right fee and proof you can show the court. We serve trial, deposition and records subpoenas across Collin, Dallas, Denton and Tarrant counties, and handle out-of-state subpoenas that need a Texas witness.

Who can serve a Texas subpoena

Texas Rule of Civil Procedure 176.5 is broader than the citation rule: a subpoena may be served anywhere in Texas by a sheriff or constable, or by any person who is not a party and is at least 18. So why hire a server? Because the subpoena only matters if you can prove it was served properly when the witness doesn't show — and the proof is what we do best.

Service means delivering a copy to the witness and tendering any fees the law requires. We handle that tender for you (witness fees at cost + $10) and document it in the return.

Types of subpoenas we serve

Out-of-state subpoenas for a Texas witness (UIDDA)

Texas has adopted the Uniform Interstate Depositions and Discovery Act (Texas Civil Practice and Remedies Code chapter 20, with Tex. R. Civ. P. 201.2). If your case is pending in another state and the witness or records are in DFW, the out-of-state subpoena is submitted to the clerk in the Texas county where discovery is sought, and the clerk issues a Texas subpoena. Once it's issued, we serve it like any other — with GPS, photos and a sworn return you can send back to your home court. Out-of-state firms: email the issued Texas subpoena and we'll handle the rest.

Pricing

CountyRoutineRushSame-day
Collin$85$135$175
Denton$85$135$175
Dallas$95$145$185
Tarrant$110$160$200

Inside those four counties travel is included — no mileage, wherever the address is. Outside them: Collin rates plus $15 for each additional 5 miles beyond 20 miles from our North Plano base, confirmed in writing before we accept. Every tier includes up to three attempts, GPS + photo on each one, a live tracking link and a court-ready affidavit of service.

Witness-fee handling is at cost + $10. Records subpoenas to large companies are often fastest through the registered agent — see serving a business.

Payment-first, no surprises: a human reviews every request before anything happens. Once it's approved you get a secure pay link — nothing starts until it's paid, and nothing is ever charged if we can't take the job. No invoicing, no payment plans.

Timing — give the witness the notice the rules require

Courts look at whether a witness had a reasonable time to comply, and deposition and records subpoenas often have notice requirements of their own. Serve early. If your hearing is close, tell us at intake — we'll say honestly which speed makes it, and Rush puts the first attempt within 24–48 hours.

When the witness won't take it

Witnesses dodge too. Our attempts are spread across times and days — including an optional early-bird attempt (6:00–7:30 AM, +$35) — and every one is logged. A clean record of attempts helps your attorney decide the next step with the court.

Never on Sunday — Tex. R. Civ. P. 6 bars serving civil process on Sundays. Saturdays and evenings are standard.
