Serving divorce papers in Texas — done right the first time

Filed for divorce in Collin, Dallas, Denton or Tarrant County? Your spouse has to be formally served before the case can move — unless they sign a waiver. Here's how it works, what it costs, and how we keep it calm and documented.

Two ways your spouse can be brought into the case

After you file an Original Petition for Divorce, Texas gives you two main options:

1. A waiver of service

If your spouse agrees the divorce is happening and is willing to sign, they can sign a waiver of service (Texas Family Code §6.4035) after the petition is filed. The waiver has to be sworn before a notary who isn't an attorney in the case, and it can't be signed before the petition is on file. If that's your situation you may not need a process server at all. If they need a notary to sign it, our mobile notary comes to them.

2. Personal service of the citation

If your spouse won't sign a waiver, can't be reached, or you simply want it done formally, the clerk issues a citation and a qualified server delivers it with a copy of the petition — and any temporary restraining order or standing order your county requires. That's what we do, every day, across DFW.

What we deliver — and what you get back

Calm, discreet, and on your schedule

Divorce serves are personal. We don't make a scene, we don't serve in front of children when we can avoid it, and we don't announce why we're there to neighbors. You can tell us the best and worst times, places to avoid, and anything about safety. If there's a protective order involved, see our protective order service page — those intakes get suppressed tracking details automatically.

Many spouses aren't hostile — they just want it done privately. If they've agreed to meet at a set time and place, serve by appointment is a flat $60. If they no-show, it converts to regular attempts and your $60 counts toward it.

Price

CountyRoutineRushSame-day
Collin$85$135$175
Denton$85$135$175
Dallas$95$145$185
Tarrant$110$160$200

Inside those four counties travel is included — no mileage, wherever the address is. Outside them: Collin rates plus $15 for each additional 5 miles beyond 20 miles from our North Plano base, confirmed in writing before we accept. Every tier includes up to three attempts, GPS + photo on each one, a live tracking link and a court-ready affidavit of service.

Payment-first, no surprises: a human reviews every request before anything happens. Once it's approved you get a secure pay link — nothing starts until it's paid, and nothing is ever charged if we can't take the job. No invoicing, no payment plans.

Deadlines that matter in a Texas divorce

If your spouse is avoiding service

It happens — especially in contested cases. Our attempts are spread across different times and days, with early-bird and evening options, and every one is logged. After diligent attempts we prepare a sworn due-diligence affidavit so your attorney (or you, if you're representing yourself) can ask the judge for substituted service — including service by social media or email when the court authorizes it.

We're process servers, not lawyers. We can't tell you which forms to file or whether a waiver fits your case — but we'll serve whatever the court issued, quickly and with proof that holds up.

Questions people ask

How do I serve divorce papers in Texas?
After you file the petition, either your spouse signs a sworn waiver of service (Family Code §6.4035) or a sheriff, constable or certified process server personally delivers the citation and petition and files a return of service.
Can I hand my spouse the divorce papers myself?
No. A party to the case can never serve the papers in Texas (Tex. R. Civ. P. 103). A friend can't either unless they're a certified process server or the court authorizes them.
How much does it cost to serve divorce papers in DFW?
Routine service starts at $85 in Collin and Denton counties, $95 in Dallas County and $110 in Tarrant County, travel included. Serve by appointment is $60 flat when your spouse agrees to meet.
What if my spouse won't answer the door?
We make up to three documented attempts at different times and days. If they keep avoiding it, our log supports a sworn due-diligence affidavit for a Rule 106 substituted-service motion.
Will you serve my spouse at work?
Yes, when that's the best place to find them — discreetly, without announcing what the papers are. Tell us their employer, work address and hours at intake.
Do you serve on weekends?
Saturdays and evenings, yes — they're standard. Never on Sunday: Texas Rule of Civil Procedure 6 forbids it.
